Istana Negara: Yang di-Pertuan Agong’s Power of Pardon as Enshrined in the Constitution

Must Read

KUALA LUMPUR, January 6, 2025 – Istana Negara today issued an official statement reaffirming the Yang di-Pertuan Agong’s prerogative powers to grant pardons, commute sentences, or reduce punishments for offenses committed within the Federal Territories of Kuala Lumpur, Labuan, and Putrajaya.

The statement emphasized that these powers are enshrined under Article 42(1) and (2) of the Federal Constitution and are exercised on the advice of the Pardons Board, which is chaired by His Majesty.

“Istana Negara stresses that all applications for pardons or sentence reductions must be submitted by the concerned prisoner to the Pardons Board for deliberation during its upcoming meeting,” the statement read.

It further urged all parties to respect the Federal Constitution and the rule of law, emphasizing that the process of granting pardons is an exclusive right subject to established procedures.

Implications of the Pardon Decision
This announcement comes amidst heated discussions about the status of a full pardon application for former Prime Minister Datuk Seri Najib Tun Razak, who is currently serving a prison sentence following his conviction in the SRC International case.

The Istana Negara statement serves as a stern reminder not to politicize or use the issue of royal pardons as a tool to pressure the royal institution and judiciary.

The Yang di-Pertuan Agong’s forthcoming decision on the pardon is expected to remain a focal point of attention among political observers and the Malaysian public.
