The Ipoh High Court heard that senior police officer Nazri Abdul Razak, who rammed into student Zaharif Affendi Zamrie with his Perodua Ativa car, was travelling at 90.9kph at the time of the collision, and his brake light was not activated, meaning the brake pedal was not pressed at the time.

ABS and VSC Data Analysis

Perodua technical assistant Ameerul Aidil Adha Jamharuddin, 31, said he obtained the information from data recorded by the anti-lock braking system (ABS) and vehicle stability control system, which stores all vehicle safety operation data.

"The steering angle was at -2.5 degrees. The accelerator was at a maximum, causing the brake assist to not operate due to the acceleration," he said when reading his witness statement before Justice Bhupindar Singh at the trial of Nazri, which entered its 13th day today.

The 25th prosecution witness said the ABS/VSC system only recorded pre-collision brake data, with no brake assist data recorded.

"The pre-collision brake warns the driver if there is a vehicle or pedestrian in front, while the brake assist kicks in if the driver is about to collide. However, the brake assist will not work if the driver overrides this system by swerving, braking or accelerating the vehicle," he said.

Forensic Medicine Expert Testimony

Earlier, forensic medicine specialist Dr Ain Nurfarahana Hamdan, 35, said she agreed with defence lawyer M Athimulan, who suggested that Zaharif Affendi, 17, suffered a "trauma death" before being confirmed dead about 30 minutes after the collision.

Athimulan: Do you agree with me that trauma death can be prevented by providing proper, fast and effective treatment facilities and access to injured people?

Ain Nurfarahana: I generally agree.

Athimulan: Since this case is one of trauma death, the injuries found on the victim’s body must be consistent with the damage to the clothing. Agree?

Ain Nurfarahana: Agree.

During re-examination by deputy public prosecutor Afzainizam Abdul Aziz, the witness said she suggested that Zaharif Affendi did not die immediately after the collision because foam mixed with blood was found in his respiratory tract in the post-mortem examination.

Ain Nurfarhana said, for example, that an injury can cause immediate death when it involves injury to the brain stem.

"I can suggest that the deceased showed signs of life because in his respiratory tract there were bubbles mixed with blood. This usually happens when someone is short of breath," she said.

Nazri, 45, is charged with murdering Zaharif Affendi at Jalan Taman Jati 1 near SMK Jati in Ipoh between 11.45am and 12.32pm on Dec 15, 2023. He is charged under Section 302 of the Penal Code for murder, which carries the death penalty or 30 to 40 years’ imprisonment and a minimum of 12 strokes of the cane, if convicted.
